Privacy Policy

Sensory, Inc. (“Company,” “we,” “our,” or “us”) respects your privacy and is committed to protecting it through our compliance with this privacy policy (“Policy”). This Policy describes (a) the types of information we may collect from you or that you may provide when you visit a Sensory owned Interface, application, or tool (collectively termed “Interface”) that references this policy, and (b) our practices for collecting, using, maintaining, protecting, and disclosing that information.

By using the Interface, you acknowledge and agree that we may collect, use, store, transfer, process, and disclose your information, as described in this Policy, based on the lawful bases of processing outlined herein, which may include your consent, our legitimate business interests, or for the performance of a contract with you. If you do not agree with this Policy, do not use the Interface.

1) INFORMATION WE COLLECT ABOUT YOU

We collect certain types of information from you either when you provide it to us or automatically as you use our Interface. The information we collect include:

  • Information by which you may be personally identified, such as name, postal address, e-mail address, and/or telephone number (“personal data”);
  • Information that you provide by filling forms on our Interface;
  • Information that is about you but does not individually identify you, such as your usage statistics and device information; and
  • Data we collect with the camera or microphone, which may include audio recordings, voiceprints, facial geometries, or other biometric identifiers and/or biometric information (where legally permissible), and associated metadata.

2) INFORMATION YOU PROVIDE TO US

The information we collect on or through our Interface may include:

  • Information that you provide by filling forms (including product inquiries, Interface forms, and demo requests) on our Interface;
  • Records and copies of your correspondence (including email addresses), if you contact us; and
  • Camera or microphone data (including recordings, voiceprints, and biometrics) that you provide directly for our product development, testing, and AI model training, especially when provided under a specific agreement, payment, or in exchange for application usage.

3) INFORMATION WE COLLECT THROUGH AUTOMATIC DATA COLLECTION TECHNOLOGIES

As you navigate through and interact with our Interface, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your use of our Interface, including traffic data, usage statistics, and data logs; and
  • Your browser information, which includes but is not limited to your IP address, referring/exit pages, operating system, date/time stamps, device type, and the pages you are requesting.

We may also use Google Analytics or other third-party analytics providers to automatically collect information on how you use our Interface. This information does not identify you. We collect this information in order to:

  • Better understand our customer base;
  • More efficiently operate our business;
  • Promote our products and services; and
  • Improve the quality of the Interface.

4) HOW WE USE YOUR INFORMATION

We collect your information to:

  • Respond to customer requests for information;
  • Inform customers of potential upgrades or changes for Sensory-related products;
  • Manage and respond to your job applications;
  • Streamline how the Interface is used and to gather information about our user base;
  • Enforce this Policy and the Terms;
  • Promotional purposes;
  • Assist law enforcement;
  • Develop, train, validate, and improve our current and future neural network models and other AI recognition technologies, including for speech recognition, wake words, voice biometrics, face biometrics, and sound identification;
  • Create aggregated, anonymized, or de-identified data sets for use in research, analysis, and commercialization, where the data can no longer reasonably identify you;
  • Retain recordings and associated biometric data for the duration necessary to achieve the stated product development and training goals, or as required by law;
  • For internal research and analytical purposes to monitor, maintain, and enhance the performance and security of our Interfaces and technologies, and
  • For any purpose described in this Policy or described to you at the time of collection.

5) INFORMATION DISCLOSURE

We may disclose your audio/video recordings and biometric data (where applicable) to our service providers and partners strictly for the purposes of AI model development, data labeling, testing, and validation, as described in Section 4. Any such disclosure is governed by a written contract that requires the third party to protect the data consistent with this Policy and applicable laws.

We do not “sell” or “share” your personal information, including recordings or biometric data, to third parties for monetary or other valuable consideration for cross-context behavioral advertising.

We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on our Interface.

6) APPLICABILITY OF THIS POLICY

This Policy does not apply to information collected by any third party, including through any application or content (including advertising) that may link to or be accessible from or on the Interface unless explicitly stated otherwise. This Policy does not apply to various Sensory partners who may be linked to a Sensory Interface or to any person or company that Sensory does not own or manage. We encourage you to visit the partner Interfaces to view their privacy policies.

7) RECORDING AND USE OF IMAGES, AUDIO, BIOMETRICS AND METADATA

Sensory products may collect audio recordings, images, text provided by users, and associated biometric information (such as voiceprints and facial geometries where applicable), along with metadata in the course of product use. The metadata may include but is not limited to timestamps, device model, OS version, microphone, camera, and/or browser information.

Specific Use of Sensitive Data:

  • This data is uploaded to Sensory for the essential purpose of developing, training, and testing our AI recognition technologies (as outlined in Section 4) and to ensure our products function effectively in real-world environments.
  • We may provide this data to third-party data processors and labeling service providers under a strict, written non-disclosure and data processing agreement, limiting their use solely to the agreed-upon product development purposes.
  • By using Sensory products, you agree that Sensory has the right to process and retain this data for the necessary development lifecycle, subject to your right to request deletion as provided by applicable law. Sensory will treat this data with the safeguards described in this Policy.

8) CALIFORNIA USER RIGHTS

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Interface that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Sensory does not disclose personal information to 3rd parties for marketing purposes.

9) INSOLVENCY AND BUSINESS TRANSITIONS

If we should ever file for bankruptcy or engage in a business transition such as a merger with another company, or if we purchase, sell, or reorganize all or part of our business or assets, we may disclose your information, including personal data, to prospective or actual purchasers in connection with one of these transactions.

10) CHILDREN

Our Interface is not directed towards children. You must be eighteen (18) years of age or older to use our Interface. We will never knowingly collect any personal information from children under the age of eighteen (18) without parental approval and signed consent. If we learn that we have collected personal information from a child under the age of eighteen (18) without parental approval, we will delete the information immediately. If you believe personal information from an individual under the age of eighteen (18) has been provided to Sensory, please notify us at [email protected].

11) DATA SECURITY

We have implemented measures designed to secure your personal data from accidental loss and from unauthorized access, use, alteration, and disclosure. The information you provide to us is stored on secured servers.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal data, we cannot guarantee the security of your personal data transmitted to our Interface. Any transmission of personal data is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Interface.

12) CHANGES TO THIS POLICY

We reserve the right to modify this Policy at will and from time to time. Check this page often, referring to the date of the “Last Updated” date listed above.

14) YOUR PRIVACY RIGHTS

Depending on your jurisdiction (e.g., California, European Economic Area), you may have specific rights regarding your personal data, including recordings and biometrics. Sensory is committed to facilitating these rights.

  • Right to Know/Access: You have the right to request a copy of the specific personal information we have collected about you in the preceding 12 months.
  • Right to Deletion: You have the right to request the deletion of your personal information that we have collected, subject to certain legal exceptions (e.g., necessary to complete a transaction, comply with law, or detect security incidents). Note: Due to the nature of AI model training, the immediate deletion of data already incorporated into aggregated, production models may not always be feasible, but we will make reasonable efforts to delete from our training data stores.
  • Right to Opt-Out of Sale/Sharing: We do not sell your personal information, as those terms are traditionally defined. You can opt-out of certain data sharing by emailing us at the address below.
  • Right to Correction/Rectification: You have the right to request correction of inaccurate personal information.
